1. About Fashfx

Fashfx is an AI-powered fashion visualization platform that enables users to:

• Generate virtual try-on images
• Create fashion collections from sketches, swatches, and flat drawings
• Generate fashion marketing assets and campaigns
• Edit, composite, and enhance fashion imagery
• Create AI-generated fashion videos and visual content
• Access related AI-powered fashion design and merchandising tools

2. Eligibility

You must be at least 18 years old or have legal authorization from a parent, guardian, or organization to use the Platform.

By using Fashfx, you represent and warrant that:

• You have the legal authority to enter into these Terms.
• All information provided by you is accurate and current.
• Your use of the Platform complies with all applicable laws and regulations.

3. User Accounts

To access certain features, you may be required to create an account.

You agree to:

• Maintain the confidentiality of your login credentials.
• Be responsible for all activities conducted under your account.
• Notify us immediately of any unauthorized access or security breach.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

"User Content" includes any files, images, garments, sketches, fabric swatches, product photos, designs, text, prompts, videos, logos, trademarks, or other materials uploaded to the Platform.

You retain ownership of your User Content.

By uploading content, you represent and warrant that:

• You own the content or have sufficient rights to use it.
• The content does not infringe any intellectual property rights.
• The content does not violate any applicable laws or regulations.

You grant Fashfx a limited license to process, store, display, and transform the content solely for the purpose of providing the Service.

5. AI-Generated Content

The Platform uses artificial intelligence and machine learning technologies to generate images, videos, designs, and other outputs.

You acknowledge and agree that:

• AI-generated outputs may contain inaccuracies or unexpected results.
• Outputs may not be unique.
• Similar results may be generated for other users.
• Fashfx does not guarantee commercial exclusivity of generated outputs.

Users are responsible for reviewing and validating all generated content before commercial use.

6. Intellectual Property

All rights, title, and interest in the Platform, including software, algorithms, workflows, user interfaces, branding, logos, documentation, and proprietary technologies, remain the exclusive property of Fashfx and its licensors.

Except as expressly permitted, users may not:

• Copy or reproduce the Platform.
• Reverse engineer or decompile the software.
• Create derivative works from the Platform.
• Resell or sublicense the Service.
• Remove proprietary notices or branding.

7. Acceptable Use

You agree not to:

• Upload unlawful, defamatory, fraudulent, or harmful content.
• Upload malware, viruses, or malicious code.
• Infringe intellectual property rights.
• Attempt unauthorized access to systems or accounts.
• Interfere with Platform operations.
• Use the Platform for deceptive, misleading, or illegal activities.

We reserve the right to remove content and suspend accounts that violate these rules.

8. Fashion Assets and Brand Rights

Users are solely responsible for ensuring they possess the necessary rights, licenses, and permissions for:

• Garment designs
• Fashion products
• Logos and trademarks
• Model images
• Product photography
• Marketing assets

Fashfx does not verify ownership of uploaded assets and assumes no responsibility for disputes arising from their use.

9. Subscription and Payments

Certain features may require paid subscriptions or usage-based credits.

By purchasing a subscription, you agree that:

• Fees are charged according to the selected plan.
• Subscription fees are non-refundable unless required by law.
• We may modify pricing with prior notice.
• Failure to pay may result in suspension or termination of access.

Taxes, duties, and government charges are the responsibility of the user unless otherwise stated.

10. Availability of Services

We strive to maintain reliable access to the Platform but do not guarantee uninterrupted availability.

We may:

• Modify features
• Add or remove functionality
• Perform maintenance
• Suspend access temporarily for operational reasons

without liability to users.

11. Data Security

We implement reasonable administrative, technical, and organizational safeguards to protect user data.

However, no system can guarantee absolute security. Users acknowledge the inherent risks associated with transmitting information over the internet.

12. Third-Party Services

Fashfx is not responsible for:

• Third-party policies
• Service interruptions caused by third parties
• Losses arising from third-party systems

Your use of third-party services may be governed by separate terms.

13. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Fashfx disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of generated outputs
• Continuous availability of services

We do not guarantee that generated content will meet specific business, legal, or commercial requirements.

14. Limitation of Liability

To the fullest extent permitted by law, Fashfx shall not be liable for:

• Indirect damagesy
• Incidental damages
• Consequential damages
• Lost profits
• Lost business opportunities
• Data loss
• Business interruption

Our total liability shall not exceed the amount paid by the user to Fashfx during the twelve months preceding the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless Fashfx, its affiliates, officers, employees, contractors, and licensors from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of the Platform
• Your uploaded content
• Your violation of these Terms
• Your infringement of intellectual property rights

16. Termination

We may suspend or terminate access to the Platform at any time if:

• These Terms are violated.
• Required by law.
• Necessary to protect the Platform, users, or business operations.

Upon termination, your right to access the Platform immediately ceases.
